QUESTION: Dear Legal Wiz,
Someone owes me rent in Jamaica. I need to plan ahead so that I dont waste airfare. How long is the process and about how many trips will be needed.
Shoiya
RESPONSE: Dear Shoiya
Give yourself approximately 111 days. The table below gives an approximation of the number of days to accomplish the eviction from the date the notice is served.
Notice expires from first day of service…. 30 days
Summon application to first court date……. 21 days
(This includes application, collection service, return)
Due court process from first
court date to judgement…………………. 46 days
Enforcement of order from judgment date…… 14 days
TOTAL DAYS to evict tenant for rent………. 111 days
NB: From the date one applies for summons to first actual court date, the actions involved are summons application (1 day) summons preparation (7 day), summons serve and return (7 days).
As far as court appearances go, its going to be about three court appearances aside from the application. You could consider having someone apply for the summons and arrange service and return of the affidavit. That way you commit yourself to the Court appearances.
