Jamaica Lawyer no longer responds re the ‘Probate’



DEAR LEGAL WIZ,
Hi,
My aunt and dad own a property in Jamaica, my aunt died intestate 2012 presumably married but no record found after several searches and newspaper adverts and no children.

My dad died in 2015 but still awaiting probate as my aunt’s share of property would pass to my dad as her only sibling alive following her death. My aunt’s alleged husband is also presumed to have died in 1989. However there are no records of his marriage or death as proof.

I have been waiting for the property to be signed over to me and my siblings for 8 years. The lawyer in Jamaica no longer reply to emails from me or the English lawyer for my dad’s estate.

What are my options please?
What happens to the property if I, the executor dies?

Thanks for contacting this website for information. Consider that the attorney may have met into challenges of their own, even died. Why not do some research on the wherabouts of the attorney. Why not get someone to do independent research as to any application regarding your dad’s estate Then your decision can be informed.

Thanks for contacting this website for information. No a Will does not have to be registered, and yes it can be probated. As for having a joint account, that’s a job for your attorney at law to assit in hunting the precious account. There are specific institutions they can contact on your behalf.
