Nine yeas ago, I gave someone in Jamaica some bags. The work to be done was not done, in my opinion, at least in full. I realised the other day they had the bags and am trying to retrieve them from the person, but no luck. Can I take them to Court? They are now asking for storage. Should I pay the fee?

Ownership is 90 per cent possession. Further in your case you waited beyond six years to attempt recovery. Six years is what the lawful time period in which you can start a claim in Court of law. Further, you did say ‘give’ indicating a gift, and that person may have assumed it as a gift. It will come to a question of morale on both your parts, as one question arising would be, would the bags have been ‘given’ if the work was not going to be done. On the other hand, if the items were destroyed or sold, you would not have been tempted to ask for them now, would ya. You are better off paying the storage fee, especially if a reasonable sum.
