The Jamaica business landscape is being populated with micro to small and medium-size businesses with access to public and private organisations that are willing to place at their disposal guidance, funding, and membership.
Where are the paralegal businesses in the Jamaica business landscape? Is there a consortium of paralegals in Jamaica? What is the business scope for them? Are they relegated just to being legal assistants or secretaries to lawyers? Is there any prospect for paralegals to become bosses?
In keeping with the Companies Act 2004, a business must be registered with the Companies Office of Jamaica. A paralegal business has this same privilege as any other.
It is advisable that registered paralegal businesses seek to form a consortium of paralegals with the ability and power to align itself with insurance companies and commercial banks, which are regulated by the Financial Services Commission (FSC), in order to provide services such as claims, mortgages, sale of properties, real estate, conveyance and trust.
Paralegals should also have the FSC lobby the Government to amend the Financial Services Commission Act, among others, to accommodate the regulation of the paralegal businesses.
It is also advisable that the consortium have its members indemnified by way of error and omission insurance and become registered members of international paralegal associations in the United Kingdom and the United States of America.
If the Government is serious about providing job opportunities and maintaining growth in the economy through the encouragement of micro, small and medium-size businesses, amending the FSC Act (inter alia) to regulate paralegals should not be a problem, but a stepping stone.
