QUESTION: Dear Legal Wiz,
I am a Jamerican living in Canada. If at all possible, can you provide a guide to what a power of attorney document should look like for use in Jamaica?

RESPONSE: Dear Sara,
Power of Attorney documents are tailored based on the needs, and the entities requiring the instrument. A sample power of attorney for use in Jamaica is available at SAMPLE Power of Attorney as of April 2, 2014:
It is important therefore you must view the list of requirements by the Registrar General Department (RGD) for the document to be properly registered. These requirements are listed on this site and include phrases that must be added if the person resides overseas, but lives in Jamaica, or resides in Jamaica, but created the power of attorney while overseas.
PLEASE check out types of power of attorney documents also, and where your situation has complexities, consult with an attorney.
If you rely on the sample power of attorney document, you may need to have it reviewed for a nominal fee, especially where you have to change the wordings to suit your individual situation or needs.

Guide to registering power of attorney in Jamaica is found on this site. Simple steps are that you stamp the document (once it is sealed by a Justice of The Peace or notary Public, then Register it with the Registrar General Department. You can find more on the registration on the direct website of the Registrar General Department HERE. Remember though that that website dies not always reflect the actual price as the fees are often times changing.
