DEAR LEGAL WIZ,
I have a dilemma. My mom recently died and did not get a chance to live in the house I almost finished building on the land left by my dad. My dad’s name is still even on the title.
The problem is I live in New York, and just discovered my mother had willed that land to only my brother who lives in England. So he stands to get everything. My dad had willed the land with nothing on it to my mom. My mom is now dead so I want my investment to remain with me,
Shane Jimms
Dear Shane Jimms,
Thanks for writing in. As with the other readers, we have distorted your name for multiple reasons.
Now you are going to need an Jamaican attorney-at-law to help you in resolving your issues. There is no challenge with your brother forseen as you both are close. However technicalities must be worked out with the help of an attorney-at-law. the question of seeking probate, or administration is one technicality. The issue of ownership of house versus ownership of land is another issue. The issue of the rights of your mom to pass on the house and land is another issue.
If you struggle to find an attorney, please fee free to write again.
