QUESTION: Dear Legal Wiz,
My brother and I live in England and we have a sister still living in Jamaica. My sister asked my brother and I to remove our names from the title so that she can be successful in applying for a loan to do some business in Jamaica. We asked her to do a written agreement, to promise us that my brother and I would get monies for our portion of the property we own. She refuses to give us any agreement. If we allow her to remove our names, will the doctrine of promissory estoppel apply out there in Jamaica to protect my brother and I,and to ensure we get our monies.
Lois Martin
RESPONSE: Dear Lois Martin,
The doctrine of Promissory Estoppel is not the best way in your situation based on the transactions that the title office in Jamaica concerns itself with. Please speak further with a attorney, for other options that will bring you better success.
