I have no will, how do I register land/property in Jamaica?

I found out I have no title. How can I get my Jamaica land registered where there was no will by my granddad? I need to register before selling the land.

RESPONSE: Dear Shana-Kay Bryan
Here is a guide with excerpted information from the National Land Agency. You will recognise why it is strongly recommended that you contract the services of a lawyer especially where complications are possible. This especially where you do not have official documents through conveyance or will.

Documents and dealings needed that can be sorted out with l-workers:

1. application form signed and witnessed
2. statutory declaration — written oath
3. support of proof of ownership — persons knowing you all for 30 years where applicant does not have a conveyance (eg a document that states some contractual relationship or grants some right)
4. certificate of payment of property tax
5. prechecked survey diagram — land being registered by plan as in this case
5a. You will need to contract a land surveyor/valuator/appraiser
6. any document you have eg receipt, conveyance, probate, certificate of compliance under the facilities of titles act, death certificates
7. land valuation reference number
etc

Some stages of the title preparation process by legal leg work team:

a. documents checked
b. survey plan checked at survey and mapping division
c. submit all to referee of title
d. notice of approval
e. advertisement in newspapers to ensure no caveats laid and get proof of advertisement
f. govt prepares title procedure after proof of advertisement and final fees
g. certificate of title
