Jamaica Court rejects Affidavit as insufficient


QUESTION: Dear Legal Wiz,
The man who I am suing did not collect the summons directly from the process server. The process server wrote on the affidavit that the man sent his helper to the gate to collect it. The Big Court says the Affidavit is not sufficient. I do not want my case thrown out, so I need to do another affidavit of service.

RESPONSE: Dear Geta,
The Court will advise you to do a supplemental affidavit of service. It should be headed as such. More details will be needed such as the involvement and actual actions by the person you are suing. If it is not sufficient you will need to have service done again.
