DEAR LEGAL WIZ,
I sent an agent to court to recover my property after the lawyer I had gave me a runaround for 5 years. I discovered that not even a notice was issued despite promises. This is not my first time. I usually give attornies first option and even now I havent found one good Jamaican attorney. They seem to be hustlers, or maybe I have made bad picks till I found your network. Even so my question is why does it seem that the Judges are now, since COVID, insisting on speaking to attornies at law. I cannot come to Jamaica and I have an agent whom Ive given power of attorney. How comes the Judge is saying he has to look up rules of the Court to even listen to my agent?
Mervel
Dear Mervel,
Based on research, there is no law to force one to use an attorney-at-law. However the power of agent/ attorney document must be done to Jamaican standards and given to someone who truley knows the facts of your case. At times such agents apepar in court and have been known toact as if they are actual law attornies and that may peeve any judge to decide against speaking to them.
Maybe you should get more facts in your court matter as I am almost sure it wasnt about you choosing an agent. If you find it is.. consider reporting to administration, or, othereise cause that WOULD BE BIAS on the part of the Judge.
See Parish Court Rules
See Supreme Court Rules on representation
MUST KNOW:
Agents who act by a power of attorney is empowered to represent the facts of the case while having power as an attorney at law enables one to be an agent of the law.
Anyone can be empowered by a power of attorney instrument, but only trained persons in law can be attornies-at-law
