QUESTION: Dear Legal Wiz,
In March, I went to Jamaica and my boyfriend broke down and told me he had to pay a fine for ganja he was carrying in 2009. I need to help him get it expunged as I intend to marry him. I am a Christian so I dont want this record following him around. My question is to clarify what someone over here told me. I was told that smoking ganja was decriminalised and so my boyfriend does not have a record. Can you help me with this?

RESPONSE: Dear Shana,
Possession of ganja is still illegal in Jamaica, despite the efforts of many who strive to make it legal.
Your boyfriend therefore has a criminal record. He cannot apply for expungement of his record till next year 2015.
