A good case on the superiority of the Jamaica Supreme Court



A lot of times when lawyers need to be successful, research is critical. It is only by research, one can expand one’s understanding in the legal field.

Journalists have a hard challenge to be accurate and therefore must rely on good sources before putting out articles or reports. The legal field is tricky as one must be sure to get the precedent from the highest tier and accepted references.

The following case makes a good read and highlights good references by the ruling Judges. A successful case at the Court of Appeal, it provides great principles and canons of Jamaican law that would be advantageous to litigants in similar cases or with similar issues of law to deal with.

It speaks about the Supreme Court being a court of pleadings and therefore superior to Parish Courts. Orders 8 and 19 rule 5 of the Resident Magistrate Court Forms and Rules book would be supporting references.
Now be wise in understanding that the added input especially processing by an attorney-at-law would now be necessary to help piece your case together for successful litigation.
